TN Visa: Treaty NAFTA
Description
The North American Free Trade Agreement provides for the temporary entry of Mexican and Canadian business persons to engage in activities at a professional level.
TN VISA ADVANTAGES
Permission To Work
Allows Canadian and Mexican business persons to work in the United States at a professional level of employment.
Earnings
The TN professional is allowed to receive a salaried income from the employer.
Duration
The TN visa is granted in increments of one year, but can be extended each year without limitation on the number of extensions.
Spouses & Children
The TN visa allows for entry of spouses and children under of 21 years of age by way of the "TD" Treaty Dependent classification.
Dependents Permitted To Attend School or College
The spouse and children under twenty one year of age are permitted to attend school on their TD visa status.
TN VISA REQUIREMENTS
Nationality
The applicant must be a citizen of Canada or Mexico and coming to perform professional services of a temporary nature for a United States employer.
Professional
The TN applicant must be qualified as a professional the occupation must be listed in the Appendix 1603.D.1 to Annex 1603 of the North American Free Trade Agreement, as follows on the next page:
Duration
The TN visa is granted in increments of one year, but can be extended each year without limitation on the number of extensions.

TN VISA LIMITATIONS
Spouse & Children Not Allowed To Work
Dependent spouses and children are not permitted to work on TD visa status.
Short Duration
TN visas must be renewed every 12 months.
Nonconvertible To Permanent Residence
TN visas are not convertible to lawful permanent residence status, however, TN status does not preclude qualification under another visa classification.
